B2B ONLY. All auction sales on fynixpro.com are made exclusively to businesses and sole traders. By registering and placing a bid you confirm that you act within your trade, business or professional activity. These Terms grant no consumer rights.

1. Seller

FynixPro, Ružomberok, Slovakia (company details, IČO/DIČ to be inserted). Contact: support@fynixpro.com.

2. Business status

Only businesses and sole traders may bid. Lots with a current bid above €150 and all pallet lots require a valid business ID (IČO or EU equivalent) on the account. The Seller may verify the ID in public registers and suspend accounts with false data.

3. Description, condition and grades

The written description and the manifest are the binding description of a lot; photos and titles are illustrative. Unless a grade states otherwise, lots are sold “as is, where is, with all faults”. Grades: NEW (unused, packaging may be damaged; 12-month functional warranty), TESTED (customer return, power-on and basic function checked), RAW (customer return, not inspected — may have any defect or be incomplete; quantity only is guaranteed), UNSPECIFIED (no information available).

4. Bids and contract

Every bid is an irrevocable offer to buy the lot at that price. Proxy (maximum) bids are supported; the system raises your bid by the increment up to your maximum. Lots may carry a reserve price set before the auction starts; if the reserve is not met the lot is not sold. A bid in the last 2 minutes extends the auction by 2 minutes. The Seller never bids on its own lots. The contract is concluded when the Seller sends the dispatch confirmation; until then the Seller may cancel an order (pricing error, suspected fraud, lot unavailable) with a full refund.

5. Price, VAT and delivery

Prices are in EUR. The Seller is currently not a VAT payer; no VAT is charged. Delivery costs are shown on the lot page before bidding and are added at checkout. Pallet buyers must ensure truck access, unloading equipment (pallet truck / forklift) and a person authorised to sign; costs of failed delivery, re-delivery and storage are borne by the buyer.

6. Payment

Payment for a won lot including delivery is due by 23:59 (CET) on the day the auction closes (minimum 6 hours after close). Unpaid orders are cancelled and recorded as a missed payment. Two missed payments within 12 months limit bidding; three lead to a permanent block.

7. Delivery, risk and inspection

Dispatch within 3 working days of payment. Risk passes on handover to the buyer or the carrier. Inspect the parcel on receipt: visible damage must be noted in the carrier’s protocol or the delivery refused.

8. Claims and returns

All sales are final; there is no automatic right of return. The 14-day consumer withdrawal right does not apply to B2B sales. Claim windows: transport damage — at receipt (carrier protocol) and notice within 24 h; shortage against the manifest — within 48 h of delivery with unboxing photos; non-conformity with the written description or grade — within 7 days; late dispatch — within 14 days of the dispatch confirmation. Claims outside these windows are not accepted. Remedies are refunds, not replacements. Initiating a chargeback without first using this claims procedure is a material breach and suspends the account.

9. Seller warranties

The Seller warrants that, on delivery, the lot conforms in all material respects to the written description and manifest. Quantity guarantee: if fewer items are delivered than listed in the manifest, the Seller refunds a share of the lot price proportional to the RRP of the missing items. Grade NEW carries a 12-month functional warranty (refund; return at buyer’s cost). Implied warranties are excluded to the extent permitted by the Slovak Commercial Code.

10. Buyer obligations

Act in good faith; ensure goods comply with applicable safety rules (including GPSR) before resale; remove original retailer labelling where required; comply with EU export/import rules. Devices with storage may contain previous users’ data — the buyer is solely responsible for secure erasure.

11. Liability

Nothing excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law. Loss of profit, business, goodwill, data and indirect or consequential loss are excluded. Total liability is limited to 100% of the price paid for the lot concerned.

12. Prohibited conduct

Off-platform deals using contacts obtained here; using the Seller’s images or trademarks without consent; more than one account per person or company; fraudulent or abusive behaviour.

13. Governing law

These Terms and every contract are governed by the law of the Slovak Republic (Commercial Code, Act No. 513/1991 Coll.). Disputes are subject to the exclusive jurisdiction of the Slovak courts at the Seller’s seat, to the extent permitted by Regulation (EU) 1215/2012.
